The online and mobile website and all subdomains (collectively, the "Website") and the mobile applications and other electronic services, including SMS banking (collectively, the "Applications") of Point Breeze Credit Union are offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein. We refer to the Website and our Applications as the "Online Services." Your use of the Point Breeze Credit Union Online Services constitutes your agreement to all said terms, conditions, and notices.

General

These Terms of Use apply in addition to any other terms or conditions applicable to any specific Online Services.

The Website is provided only for informational purposes. Any and all information, materials, product offerings, services, rates, fees, and terms are subject to change without notice.

Not all of the products or services described on the Website are available in all geographic areas. Point Breeze Credit Union serves anyone who works, worships, volunteers, or belongs to an organization located within 20 miles of any Point Breeze Credit Union location, as well as immediate family members of, or anyone sharing a residence with, anyone meeting this criterion. We reserve the right to determine your eligibility for any product or service.

Investment and Insurance products and services are offered by a third-party, are not credit union deposits and are not insured by the National Credit Union Administration, are not guaranteed by Point Breeze Credit Union, and are subject to substantial risk, including the possible loss of some or all of the principal invested.

Your accessibility and use of the Online Services is completely at your risk. Except as expressly provided elsewhere, the Online Services and the related information, materials, and services, including but not limited to text, software, graphics, and source code are provided “as is” without warranty of any kind, whether expressed or implied. Without limitation, all expressed or implied warranties of merchantability, title, fitness for a particular purpose, or infringement, are hereby disclaimed and excluded. Indemnification

You agree to defend, indemnify, and hold harmless Point Breeze Credit Union and all of its respective directors, officers, employees, volunteers and agents thereof, from and against all claims and expenses, including attorney's fees, arising out of your violation of these Terms of Use or misuse of the Online Services.

You are prohibited from sharing with us information of a third party, such as a co-applicant on a loan or account application, without you first obtaining the third party’s authorization to share the information with us.

This agreement shall be governed by and construed in accordance with federal statutes and the laws of the State of Maryland. Our Online Services are not intended for distribution to, or use by, any person or entity in any jurisdiction or country where such distribution or use would be contrary to local law or regulation.

Online Chat

At any time and at our sole discretion, Point Breeze Credit Union may make interactive online chat (“Chat”) service available to you. Point Breeze Credit Union makes no warranty that Chat service will be available at any particular time or be free of fault or error.

The Chat service is provided as a convenience to you. Our Chat service agents will try to provide you with accurate and current information based on your question or need. Nothing we communicate in the Chat service will be considered a legal agreement, representation, or warranty as to our products, services, processes, decisions, or response times. Providing or participating in the Chat service does not constitute consent by you or us to use electronic records and signatures as a substitute for written documents.

You will not use the Chat service to send any abusive, defamatory, dishonest, or obscene message, and doing so may result in termination of the Chat service session.

Waiver of Jury Trial and Class Action Claims

All parties agree to waive any right to participate in any class action or any similar representative multiple party plaintiff/claimant group, and agree to waive any right to have a jury participate in the resolution of any dispute or claim between or among the parties or any of their respective heirs, successors, affiliates, licensors, contractors, service providers, or the employees or contractors of any of these, arising under or relating to our Online Services and/or these Terms of Use.
